Appointed by the U.S. District Court for the District of Columbia to mediate a challenge to the National Oceanic and Atmospheric Administration's (NOAA) alleged failure to comply with a deadline under the Marine Mammal Protection Act (16 U.S.C. §§ 1362-1421h) to issue final Atlantic Large Whale Take Reduction Plan implementing regulations pursuant to 16 U.S.C. § 1387(f)(7). Based on the mediation, the parties settled the case and the regulations were published in the Federal Register.

Tittabawassee and Saginaw Rivers Mediation, Midland, MI. A member of the firm is mediating negotiations for response costs, response actions, corrective action, and natural resource damages regarding the nature and extent of hazardous substances in soils and sediments in the City of Midland; the Tittabawassee River; the Saginaw River; and the Saginaw Bay of Lake Huron pursuant to the Comprehensive Environmental Response, Compensation, and Liability Act, 42 U.S.C. §9601 et seq.; the Resource Conservation and Recovery Act, 42 U.S.C. § 6901 et seq.; the Clean Water Act, 33 U.S.C. § 1251 et seq.; and Parts 31, 111 and 201 of the Michigan Natural Resources and Environmental Protection Act, MCL 324.101 et seq.

Renovation and re-leasing of an environmentally contaminated industrial facility in Berkeley, Missouri.

Leasing and debt restructuring of a Washington, DC hospital facility.

Joint venture development of a major office project in Ballston, VA by a national developer and life insurance company and the construction financing thereof.

Carter Industrials site, Detroit, MI. Managed the construction of a large (100,000+ documents) database that converted disparate records into volumetric calculations of wastes sent to the site, mediated allocation disputes among more than 30 Potentially Responsible Parties (PRPs) and issued a non-binding arbitration award that settled the case.

Garvin v. AARP et al., United States District Court for the District of Columbia. Appointed by the US District Court to mediate a breach of contract and age discrimination employment dispute.

Gant v. Davis Memorial Goodwill Industries, Inc. et al., United States District Court for the District of Columbia. Appointed by the US District Court to mediate an employment discrimination and sexual harassment dispute.

Rhinelander Landfill, Rhinelander, WI. Selected to mediate the settlement of a cost allocation dispute between generators and the owner/operator of the site.

Mid-State Landfill, Cleveland Township, WI. Mediated the settlement of a contribution dispute between industrial PRPs and a group of local governments.

American Arbitration Association, Charlotte, NC. Mediated an environmental dispute about cleanup levels, future use and funding of the cleanup of a parcel of property adjacent to the Charlotte professional football stadium complex.

Sugarbush Ski Resort Water Dispute, Waterbury, VT. Mediated the settlement of dispute among Sugarbush Ski Resort, the Vermont Department of Natural Resources and environmental and conservation groups over water withdrawal rights for snow making.

EDO Corp., et al. v. Elinco Assocs., et al., United States District Court for the Southern District of New York. Mediated the settlement of lengthy CERCLA cost recovery litigation between plaintiff and defendants. Issues included intra-generational family inheritance issues.

Tulalip Landfill, Marysville, WA. Convened a PRP group and mediated discussions among PRPs, the US Environmental Protection Agency and Federal defendants about allocation procedure at site, and facilitated discussions among parties and PRPs, EPA and tribal government about future use and potential remedies at the site. Selected to issue Pilot Project allocation award to settle allocation disputes between non-settling parties. Drafted an award that was accepted by all remaining parties.

City of Rice Lake Landfill, Rice Lake WI. Consultant to the City of Rice Lake, WI to assist in identifying records regarding landfill operations, identify parties, and prepare an allocation pursuant to the applicable Wisconsin Statute.

Barrow Landfill, Barrow, AK. Mediated the establishment of an allocation procedure and selected to allocate costs of the cleanup of a landfill located in the northern-most community in North America. Parties included the U.S. Navy, the U.S. Air Force, the North Slope Borough. Obtained information regarding waste disposal practices on the North Slope, including conducting interviews with witnesses Drafted a report summarizing and evaluating the history of waste generation, disposal, and landfill facility operations in Barrow, and recommending an allocation among the parties. Mediated the settlement of the allocation dispute.

Marvin Duren et al. v. Worthington Custom Plastics et al., United States District Court for the Southern District of Ohio. Mediated a toxic tort case under the Clean Air Act, CERCLA, RCRA and state law.

United States of America, et al. v. J.B. Stringfellow, et al., United States District Court for the Central District of California, Los Angeles Division. Appointed by the US District Court as the neutral expert to evaluate an allocation disputes between of parties.

Conservation Law Foundation, Inc., et al. v. Donald Evans, et al., U.S. District Court for the District of Columbia. Appointed by the US District Court with agreement of the parties to mediate settlement discussions regarding the New England groundfish fishery's conservation and management requirements to comply with the Magnuson-Stevens Fishery Conservation and Management Act and the Sustainable Fisheries Act.

Village of Freeport Electric, Inc. Clean Air Act Case, New York, New York. Mediated negotiations among the US Environmental Protection Agency, the Village of Freeport, New York and Freeport Electric, Inc. regarding the assessment of a civil penalty pursuant to 113(d) of the Clean Air Act, 42 U.S.C. 7401 et seq.

Midnite Mine Site Facilitation, Spokane Reservation, WA. Facilitated discussions among the Spokane Tribe of Indians, the Bureaus of Land Management and Indian Affairs and the US Environmental Protection Agency regarding federal Indian law, land-management, future use, and cleanup issues related to an inactive, open-pit, uranium mine.

Legal Services Corporation Rules 1611 and 1626 Negotiated Rulemaking, Legal Services Corporation (LSC) Washington, DC. Facilitated two negotiated rulemakings, one to rewrite 45 CFR Part 1611 regarding LSC Financial Eligibility regulation, and one to rewrite 45 CFR Part 1626, LSC regulation regarding Restrictions on Legal Assistance to Aliens.

I-73 Interagency Coordination Team Facilitation, South Carolina. Facilitated interagency coordination team meetings to draft an Environmental Impact Statement (EIS) and apply for a permit to fill wetlands in order to construct I-73, a new interstate multi-modal transportation corridor in South Carolina. Participants include all South Carolina and federal natural resource, environmental, historic, economic development, emergency management, and transportation agencies.

Advisor to US Department of Commerce contracting officers responsible for building Weather Forecast Offices throughout the United States regarding Federal Acquisition Regulation, Budget Legislation and Department policy.

Legal advisor to the Fleet Replacement and Modernization Program whose purpose was to build a modernized fleet of ships for the Army Corps of Engineers.

Counselor to 501(c)(3) church organization in the development and management of a federal credit union and a medical center.

Legal Lead facilitator and project manager to plan and prepare, and then facilitate by a team of four facilitators of a national meeting for EPA's Office of Solid Waste & Emergency Response and Office of Enforcement and Compliance Assurance. The meeting, between representatives of EPA, federal, state, and tribal organizations, developers, local communities, and industry provided a forum for sharing concepts and dialogue regarding EPA guidance of effective post-construction activities at Federal, State, Tribal, local and private party cleanup sites.
